The Headline, and the Contradiction Inside It
On September 24, Bloomberg reported that Oracle sent a “force majeure” notice to Blue Owl Capital, the alternative-asset manager that owns Stack Infrastructure, the developer building Project Jupiter – a 2.5-gigawatt AI data center campus in Santa Teresa, New Mexico, that Oracle signed on to as anchor tenant in January 2026. Per Data Center Dynamics’ report on the Bloomberg story, Oracle isn’t trying to walk away from the site; it’s trying to delay the payments it would owe if the campus fails to come online on its planned 2028 timeline, while keeping its tenancy intact. A force majeure clause is a standard contract provision that frees a party from liability when circumstances beyond its control prevent performance – and lawyers reach for it when a project is genuinely at risk of missing its date.
Within hours, Oracle’s own X account pushed back without directly addressing the Bloomberg report: “Project Jupiter remains on our planned schedule. We are fully committed to New Mexico and confident in our path forward,” adding that the company expects “more than $4.7 billion in economic benefit” for the state. That’s an unusually fast, unusually specific denial for a company that doesn’t typically respond to single Bloomberg stories in real time – and it sits awkwardly next to a legal filing that exists precisely because the company wants contractual protection if the 2028 date slips.
This Didn’t Come Out of Nowhere
This blog’s Sept 11 post covered Oracle’s fiscal Q1 2027 earnings as a bellwether for AI-capex durability: OCI revenue more than doubling, a record $664B backlog, and raised guidance. Project Jupiter setbacks in the weeks since complicate that story considerably, and most of them hadn’t been reported yet when that post went up:
| Date | Development |
|---|---|
| Jan 2026 | Oracle announced as anchor tenant of Project Jupiter |
| Apr 27, 2026 | Oracle and BorderPlex Digital Assets switch the campus’s power plan to Bloom Energy natural-gas fuel cells instead of gas turbines |
| Aug 14, 2026 | Oracle’s $165B data center plan hits a gas-pipeline delay (OilPrice.com) |
| Sept 2026 (early) | Oracle issues an RFP for 2GW of new renewable capacity in New Mexico to support the site, plus up to $1M for carbon-capture research |
| Sept 17-18, 2026 | NM Supreme Court lifts a stay it had placed on air-quality and water-use permits, after environmental groups’ due-process challenges had paused state regulatory review |
| Sept 18, 2026 | Financial Times reports $18B of the project’s data-center debt is “under strain amid local pushback” |
| Sept 23, 2026 | Local reporting (KUNR) confirms water access has resumed for construction |
| Sept 24, 2026 | Bloomberg reports the force majeure notice to Blue Owl; Oracle shares fall, Oracle publicly disputes the framing |
The underlying numbers explain why this matters beyond one contract dispute: Project Jupiter was approved via $165B in industrial revenue bonds from Doña Ana County commissioners in 2025, on a 1,400-acre site – bigger than Central Park – that’s meant to anchor a meaningful share of Oracle’s AI infrastructure build-out for OpenAI and other cloud customers. It has drawn sustained local opposition over environmental impact and transparency (including nondisclosure agreements between the local water utility and the developer, which drew criticism when they surfaced), and the legal fights over its permits are not fully resolved even now – the Supreme Court lifted a stay, it didn’t grant final approval.
Market Reaction Wasn’t Limited to Oracle
CNBC reported Oracle shares sank as much as 5% on the news; other outlets (CryptoRank, Investor’s Business Daily) put the intraday move closer to 7%, and Yahoo Finance’s live trending data showed ORCL down roughly 4.1% on the day, enough to erase the stock’s gains back to early-August levels. The damage wasn’t contained to Oracle: Blue Owl – already down more than 45% over the trailing year, per 247wallst’s reporting – fell further on the news, and Bloom Energy, the fuel-cell supplier contracted to power part of the site, slid in sympathy (Seeking Alpha, TradingView). FXStreet’s framing was blunter: “Oracle’s force majeure on New Mexico data center sends AI stocks lower,” tying the move to the broader AI-infrastructure trade rather than treating it as an Oracle-specific event.
Why This Belongs in the AI CapEx Conversation
This blog’s running thread on AI capex has so far been a string of confirmations: Oracle’s record backlog (Sept 11), Microsoft’s plan to triple data center capacity to 38GW (Sept 12), Broadcom’s $230B AI revenue framing (Sept 7), Qualcomm-Amazon’s chip deal (Sept 9). Project Jupiter is the first entry in that thread where the friction is concrete and legally documented rather than an analyst’s forward-looking caution (like Wells Fargo’s Sept 24 note cutting its S&P 500 target on 2028 AI-spending math, which is opinion, not fact). A force majeure notice is not filed casually – it’s the kind of document a company’s legal team prepares when a real possibility exists that a marquee, multi-billion-dollar project misses its committed date, and it exists in direct tension with the company’s own public messaging about that same project on the same day.
None of this means the AI capex build-out is stalling broadly; Microsoft, Broadcom, and Amazon have shown no comparable strain, and Oracle’s overall backlog and guidance from two weeks ago haven’t been revised. But it is a concrete data point that the execution risk behind trillion-dollar AI infrastructure commitments – permitting fights, power delivery, local political pushback, and financing structures involving multiple counterparties – is not hypothetical. For a single site to accumulate a gas-pipeline delay, an $18B debt-strain report, a state Supreme Court permitting fight, and a force majeure notice within about six weeks is a meaningfully different story than “capex guidance raised.” Readers tracking AI infrastructure stocks should treat Project Jupiter as a live case study in how the physical-world side of AI buildouts – land, permits, power, and construction financing – can lag the software-and-chips side by years even when the underlying demand story stays intact.

(OilPrice.com) |
