Per 24/7 Wall St.’s reporting, neither document was written in a hurry. Atkins had promised an “Innovation Exemption” on CNBC as far back as December 2, 2025 – nine months before it actually shipped – and CFTC Chair Michael Selig told the agency’s Innovation Advisory Committee on August 20 that he would give the Clarity Act “room for a vote,” then move on his own if a bipartisan bill failed. The Senate met that condition on September 15; both agencies published finished work two days later.
What Changed, Asset by Asset
The three actions did not land evenly across crypto:

Market Reaction
Bitcoin, which fell nearly 4% toward the mid-$75,000s on the Sept 15 cloture failure (as this blog covered), was trading around $80,900 as of this writing – up roughly 5.9% over 24 hours. Solana jumped over 11% to roughly $113, and XRP rose about 7.7% to $1.40, per CoinGecko data. TheStreet’s framing – “New SEC, CFTC rules after CLARITY setback fuel Bitcoin rally” – and Decrypt’s live coverage both attribute part of the bounce to the agencies visibly stepping into the legislative gap rather than to any single catalyst.
The Durability Problem Nobody Is Hiding
Both regulators have been unusually candid that this is a stopgap, not a substitute. Atkins wrote in his own announcement that the Innovation Exemption is “though temporary, a principled, structured grant of relief,” explicitly declining to call it permanent. The mechanics back that up: the Innovation Exemption expires after five years unless a future SEC chair renews it; the CFTC’s no-action letter is a staff position that lasts only “until staff changes its mind” and evaporates the moment the Commission finalizes a formal rule; and Regulation Crypto Assets is still just a proposal sitting at OIRA, with a comment period that doesn’t close until October 20.
There’s also a structural fragility point worth flagging: the CFTC currently has only one of its five commissioner seats filled – Selig’s – with four vacancies, including both seats reserved for the minority party. JPMorgan’s research team called the resulting framework “less durable than legislation,” since agency rules can be rewritten by a future chair or challenged in court, while Bernstein described the Clarity Act itself as a “foolproof shield” against exactly that kind of political reversal – a shield the industry no longer has for 2026.
Investment Read
This doesn’t reopen the question this blog’s Sept 15 and Sept 16 posts already answered – the Clarity Act is still dead for 2026, and the House has no floor session scheduled until Nov 9. What’s new is that the resulting regulatory vacuum filled faster and more substantively than the “bill is dead” headlines implied on Tuesday. For positioning: the rally suggests markets are pricing in real, if temporary, relief – concentrated in Solana given its direct tokenized-securities and wallet-framework wins, more diffuse for Bitcoin, and essentially absent for XRP, whose core legal ambiguity (CFTC spot-market authority) only Congress can resolve. The bar for the next update on this story is whether Thune schedules a second cloture vote before the midterms consume the floor calendar, or whether a court challenge or a change in SEC/CFTC leadership tests how durable these rules actually turn out to be.
