That review has not produced a public answer. As of August 4-5, multiple outlets — The Crypto Times, Coinfomania (citing crypto journalist Eleanor Terrett), CoinGeek, and CryptoRank — are reporting that the White House still has not formally responded to the Tillis-Gallego language, nearly a week after it was sent. The silence has itself become the story: CoinGeek’s framing, “White House silence on crypto ethics could doom CLARITY Act,” captures where sentiment has moved since our last post treated the proposal as a live path forward.

A Second Fight Nobody Was Tracking: Prediction Markets

While the ethics provision sat unanswered, a separate dispute surfaced this week. Tribal gaming regulators and a bipartisan group of senators are pushing to add prediction-market restrictions to the bill — arguing that platforms like Kalshi and Polymarket, which let users bet on event outcomes, should fall under gaming oversight rather than slip through as CFTC-regulated derivatives. The Block, Cryptonews, Traders Union, and gaming-industry outlets (Indian Gaming, Yogonet) all covered senators and tribal leaders pressing this amendment in the same week Thune was trying to find 60 votes. Separately, a coalition of advocacy groups is also pushing to strip an AI regulatory-sandbox provision from the bill (Jurist.org). Neither dispute is new to Clarity Act’s legislative history in the abstract, but both resurfacing in the same window as the ethics stand-off adds fresh points of friction to an already-strained 60-vote math — exactly the kind of complication that makes “quick fix, quick vote” less likely.

The Odds Cratered Again

Polymarket’s probability that the Clarity Act becomes law in 2026 has kept falling: 25% on July 31 (our August 1 post), roughly 27% as of August 4 per CCN, and 14% as of August 5 per Benzinga’s tracking of the market (“Thune Floats Last-Minute CLARITY Act Vote, but Polymarket Odds Crash to 14%”). That’s a nearly 45% relative drop in less than a week, and it’s happening despite Thune publicly floating a last-minute vote — a sign the market is pricing the procedural gridlock (ethics silence plus the new prediction-market fight) more heavily than any single leader’s stated intent to force a vote.

Washington’s Backup Plan Is Now Part of the Story

What’s different from our earlier posts is that institutional actors are now openly discussing a world where the bill doesn’t pass this year. SEC Chair Paul Atkins said the agency “can deliver crypto rules without the CLARITY Act,” and Commissioner Hester Peirce made a similar point — both signaling the SEC intends to keep moving on crypto rulemaking through its own authority regardless of what happens on the Hill. Republicans still hold 53 Senate seats and need seven Democratic crossover votes to clear the 60-vote filibuster threshold — unchanged since our May 25 post. What has changed is the runway: the August 10 recess deadline we first flagged on July 26 is now five days away, and CoinGape’s August 5 headline (“CLARITY Act No Longer Expected To Pass In 2026”) reflects a growing consensus among Capitol Hill trackers that a pre-recess vote — and possibly a 2026 vote at all — is no longer the base case. TradingView reported the broader regulatory reset could “slip into September” if the ethics fight isn’t resolved first, which would push any vote past the recess entirely and into a compressed midterm-year fall session.

The shape of this story has now inverted from where our August 1 post left it. Then: a genuine bipartisan fix was newly in front of the White House, odds had fallen but a resolution felt close. Now: six days of silence on that same fix, a second unrelated dispute (prediction markets) has entered the mix, Thune has pulled back from forcing a vote, and Polymarket odds have nearly halved again to 14%. None of this means the bill is formally dead — Congress has surprised markets before, and Thune floating a last-minute vote keeps a narrow door open. But the balance of evidence — White House silence, new procedural fights, Senate leadership retreating from a forced vote, and regulators/industry both audibly preparing for a no-bill scenario — is different in kind from the “down but still fighting” framing of our last three posts. Watch two things before the recess: whether the White House says anything at all about Tillis-Gallego in the next 48 hours, and whether Thune actually schedules floor time. Absent either, the realistic window shifts from “before August 10” to “after Labor Day, if at all this year” — a scenario markets are now visibly pricing in, not one this blog is speculating into existence.
