From “Shelved” Back to “In Play” in Two Days

Our July 28 post covered Senate leadership shelving the pre-recess floor vote and passage odds crashing to 30-37%. That was the low point of the week. Since then, the story has moved again — not to a resolution, but to a new, more specific attempt at one.

On July 30, Republican Sen. Thom Tillis and Democratic Sen. Ruben Gallego sent a bipartisan counterproposal on the bill’s ethics provisions to the White House, according to Punchbowl News, corroborated by CoinDesk, The Block, crypto.news, and Crypto Briefing. This is a materially different kind of document than the one that failed on July 27: that proposal was drafted by the White House and Senate Republicans (Sens. Lummis and Moreno) and rejected by Democrats within 48 hours. This one has an actual Democratic co-author. Trump and the White House are reviewing it over the weekend of August 1-2, with the August 10 recess deadline now nine days out.

What the New Proposal Actually Changes

The specific fix targets a narrower problem than the “temporary vs. permanent” dispute that sank the July 22 draft. The earlier ethics language would have barred the president, vice president, and other federal officials from issuing or sponsoring digital assets while in office — but gave the Department of Justice sole authority to enforce that ban. Senate Democrats objected because DOJ sits inside the executive branch, meaning the administration would effectively police itself.

The Tillis-Gallego text addresses that specific objection: it would let state attorneys general enforce the restriction alongside federal authorities, rather than leaving enforcement solely with DOJ. Crypto journalist Eleanor Terrett reported the full scope of state enforcement powers in the draft remains unclear, and the text itself has not been made public. But the mechanism is a genuine structural change to the provision that killed the last deal — not a restatement of it.

Two people are worth noting on the record. Gallego has said ethics, consumer protection, illicit finance, and conflict-of-interest safeguards “must be strengthened” before he’ll back the bill. Tillis had reportedly withheld his own support pending changes to the ethics section — meaning both signatories had a personal stake in reaching this specific text, not just a messaging exercise.

Bessent Goes Public and Aggressive

Treasury Secretary Scott Bessent didn’t wait for the White House review to play out quietly. On July 30, he posted on X demanding Senate Majority Leader John Thune bring the bill to a vote “NOW,” accusing Democrats of blocking it out of fear of Sen. Elizabeth Warren’s opposition, and framing the choice as “American Exceptionalism” versus ceding global leadership in digital assets to other countries. Per Bessent, Thune is expected to force lawmakers to state their positions on the floor in the coming days — though Thune himself has acknowledged there may not be enough time or votes left in the current session.

Bessent also flagged a second unresolved item beyond ethics: the Blockchain Regulatory Certainty Act (BRCA) provisions, which remain in dispute alongside the ethics language. That’s a reminder the ethics fight, however dominant in headlines, isn’t the only open item blocking 60 votes.

The Odds Went the Wrong Way

Here’s the part that keeps this from reading as straightforwardly bullish: Polymarket’s probability that the Clarity Act becomes law in 2026 fell to a record-low 25% on July 31 — even as the new bipartisan text was sitting in front of the White House. That’s down from the 30-37% range we cited on July 28, and well below the 55% base case we assigned back in May. Markets are pricing continued uncertainty about whether Trump signs off, not confidence that this specific fix closes the gap.

SkyBridge Capital’s Anthony Scaramucci said on X that he expects Trump to approve the Tillis-Gallego language and separately claimed Trump’s children support the compromise — but neither Trump nor the White House has confirmed acceptance, and Scaramucci later deleted the post about the family’s position. That’s opinion and unconfirmed claims, not a resolution; treat it accordingly.

Where the Math Stands

Republicans hold 53 Senate seats and need at least seven Democratic votes to clear the 60-vote threshold. The underlying House bill passed 294-134 in July 2025 with 78 Democrats already on board — a reminder that bipartisan support for the concept exists in the other chamber. Any Senate-amended version would still need to go back through the House before reaching Trump’s desk, meaning even a clean Senate passage this month wouldn’t be the final step.

Investment Read

Nothing here resolves the bill. But the shape of the news changed: instead of “White House proposal rejected, vote shelved” (our July 27-28 posts), we now have a Democrat-co-authored counterproposal narrowly targeting the exact objection that sank the last attempt, under active White House review with a public deadline (this weekend) attached to it. That’s a more concrete state than “ethics provisions unresolved.” At the same time, the falling Polymarket odds are the more reliable signal than any single senator’s optimism — markets are not pricing this as the fix that gets the bill to 60 votes, and Thune’s own acknowledgment that time and votes may be short should be weighted alongside Bessent’s public pressure campaign. Watch for two concrete tells in the next few days: whether the White House publicly confirms or rejects the Tillis-Gallego language, and whether Thune actually schedules floor time before August 10. Either would be a clearer signal than anything in this post.
