From “When Does the Senate Vote” to “Regulators Stop Waiting”

Our August 8 post covered Senate Majority Leader John Thune filing cloture on H.R. 3633 just hours before the August recess, locking in a 2:15 PM ET cloture vote for Tuesday, September 15 — the first hard, procedurally-binding date this saga has had since May. We framed that as genuine (if narrow) progress: the furthest the bill had advanced on the floor, even though the underlying 60-vote math hadn’t moved.

A week later, the story has changed shape again. Nothing has happened to the vote count itself — Republicans still hold 53 seats and need seven Democratic crossovers, and the White House still has not publicly responded to the bipartisan Tillis-Gallego ethics framework senators sent on July 30, now more than two weeks of silence. What’s new is that both the SEC and CFTC have visibly stopped waiting on Congress and started building around it, and the White House is convening the industry directly to manage the fallout.

Two things worth separating here. First, the “crashed from 82%” framing several outlets are using this weekend compares today’s odds to February’s all-time high — a six-month decline, not a sudden move since our last post. Second, and more relevant to what changed this week: since the cloture filing gave the bill a hard date, Polymarket’s implied odds have actually ticked up slightly (14% → ~19%), but Galaxy Digital’s independent house estimate — 10% — sits below even that diminished market price, and Galaxy frames the legislation as having “effectively shifted from a policy negotiation into a political one.” The gap between a hard procedural date and a barely-moved probability estimate is itself the story: locking in a vote doesn’t manufacture the votes.

The SEC Pulls Its Own Vote

The SEC had scheduled an August 14 vote on “Reg Crypto,” Chair Paul Atkins’ tailored framework for certain crypto-token offerings — one of two major initiatives (alongside an “Innovation Exemption” for tokenized securities) the agency has been developing to move crypto rulemaking forward under its existing authority, independent of whatever Congress does with Clarity. The commission canceled that meeting a day before it was scheduled, without setting a new date. The timing — right after the Senate left town without a floor vote — is why Decrypt, Yahoo Finance, and crypto.news all ran versions of the same framing this week: the agency meant to fill the gap Clarity would otherwise close is itself stalling.

The CFTC Moves the Other Direction — Aggressively

While the SEC pulled back, the CFTC pushed forward. On August 11, Chair Michael Selig invoked emergency authority after Kalshi warned that a New York lawsuit could disrupt its federally regulated event-contract markets nationwide; Selig ordered Kalshi to keep operating under federal derivatives rules, asserting that states cannot override CFTC jurisdiction. That fight — over whether prediction markets are federally regulated derivatives or state-regulated gambling — is precisely the kind of jurisdictional question Clarity Act is designed to settle permanently. The CFTC is also holding its first-ever Innovation Advisory Committee meeting on August 20, a day after the White House gathering below, bringing in executives and entrepreneurs to shape policy the agency doesn’t want to wait on Congress for.

The White House Summons the Industry — August 19

According to reports on the meeting, President Trump, CFTC Chair Michael Selig, and SEC Chair Paul Atkins are expected to meet crypto and prediction-market executives at the White House on August 19 — with Coinbase, Andreessen Horowitz, Ripple, Chainlink, Kalshi, and Paradigm reportedly invited, along with the Digital Chamber, Kraken, Gemini, the NYSE, and Nasdaq. The final list is still described as subject to change. The meeting lands four weeks before the September 15 cloture vote and reads as the administration managing industry expectations directly, given that neither the legislative nor the purely regulatory path is currently producing certainty.

The Calendar Is the Real Constraint Now

Even if the ethics standoff resolves, Galaxy Digital’s math on the Senate’s remaining bandwidth is blunt: the chamber returns September 14, the cloture vote is set for the next day, and lawmakers are expected to leave Washington around October 2 for midterm campaigning — leaving roughly three weeks of session to pass Clarity, resolve conference differences with the House’s 2025-passed version (H.R. 3633 cleared 294-134 with 78 Democrats in July 2025), and move on to whatever else is on the September floor calendar. Galaxy’s view is that the bill would need to start moving “almost immediately” upon the Senate’s return to have a realistic shot this year.

Investment Read

None of this changes our core read from the August 8 and August 5 posts: the vote math (53 Republicans, 7 Democrats needed) hasn’t moved since May, and the ethics dispute over Trump’s crypto ventures remains the single largest blocker. What’s changed is that the fight has visibly spread beyond the Senate floor — the SEC is stalling on its own fallback plan, the CFTC is asserting itself more aggressively on adjacent turf (prediction markets), and the White House is now managing the industry relationship directly rather than leaving it to Capitol Hill. That’s a sign the administration and agencies increasingly treat a 2026 Clarity Act passage as a coin flip at best (Galaxy’s 10% is closer to a long shot), and are hedging with parallel regulatory tracks that would soften — but not replicate — the effect of the bill failing. For positioning: this doesn’t resolve the “walking dead” scenario Bitwise’s Matt Hougan flagged back in early August, it deepens it. Watch September 15 as the real decision point, and watch whether the August 19 White House meeting produces any public signal on the still-unanswered Tillis-Gallego ethics framework — that remains the single biggest lever on whether seven Democrats materialize.
